Mediation and arbitration differ in several important ways:

With mediation, both parties may be represented by their own attorneys, and both agree to use our trained attorney as an unbiased mediator in a confidential forum. We carefully listen to the grievances on both sides, assist the parties in reaching an amicable resolution to the dispute and help them come up with non-binding resolutions to the issue. Either party may pull out of the mediation agreement and pursue civil litigation through a court action if a mediated resolution cannot be reached. In the end, the mediated settlement only becomes binding when both parties agree to the terms proposed and accepted by the parties.

In arbitration, an arbitrator serves as a judge, listening to the arguments of both sides and making a decision based on the facts of the case. The final resolution is in the hands of the arbitrator, rather than the parties. The decision is often binding.
